Kim Davis ordered released after marriage licenses issued in Rowan Co.

Democratic Rowan County Clerk Kim Davis has been ordered released from custody of U.S. Marshals after her deputies began issuing marriage licenses last week.

U.S. District Judge David Bunning found Davis to be in contempt of court on Thursday after she refused to issue marriage licenses in Rowan County citing her religious convictions as basis for her denial of services.

On Tuesday, Bunning ordered Davis released under certain conditions.

In the order Bunning writes that the issuance of marriage licenses by Davis’ deputy county clerks has “satisfied” the court that “Rowan County Clerk’s Office is fulfilling its obligation to issue marriage licenses to all legally eligible couples, consistent with the U.S. Supreme Court’s holding in Obergefell and this Coutr’s August 12, 2015 order.”

“Defendant Davis shall not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples,” Bunning wrote in his order. “If Defendant Davis should interfere in any way with their issuance, that will be considered a violation of this Order and appropriate sanctions will be considered.”

Bunning writes that clerks who previously agreed to comply with the law and issue licenses will file a report every two-weeks unless the court orders them otherwise.

William Sharp, legal director of the ACLU of Kentucky, representing plaintiffs in this case responded to the order to release Davis saying their the groups goals had been achieved.

“This case was brought to ensure that all residents of Rowan County, gay and straight, could obtain marriage licenses,” Sharp said. “That goal has been achieved.

“The Kentucky Attorney General and counsel for Rowan County have said the marriage licenses are valid. We are relying on those representations, and our clients look forward to proceeding with their plans to marry.”
